Harsh Penalties Follow OWI Arrests
Wisconsin takes drinking and driving charges seriously. Law enforcement can arrest you for an OWI if your BAC is over .08 or if you perform poorly on field sobriety tests. The penalties for first and subsequent OWI charges are as follows:
- First OWI offense: Misdemeanor charge with fines up to $300, license revocation for six to nine months, possible requirements include the installation and use of an ignition interlock device (IID) or participation in the 24/7 sobriety program for one year
- Second OWI offense (within 10 years): Misdemeanor charge, jail time ranging from five days to six months, fines up to $1,100, license revocation for 12-18 months, required installation and use of an IID or participation in the 24/7 sobriety program for one year to 18 months
- Third OWI offense: Misdemeanor charge, jail time ranging from 45 days to one year, license revocation for two to three years, required installation and use of an IID or participation in the 24/7 sobriety program for one to three years in addition to confinement
- Fourth OWI offense: Felony charge, jail time ranging from 60 days to six years, fines up to $10,000, license revocation for two to three years, required installation and use of an IID or participation in the 24/7 sobriety program for one to three years in addition to confinement
Aggravating factors can increase penalties. Your charges may be more severe if you:
- Possess a commercial driver’s license
- Had an open container or a controlled substance in your vehicle
- Refused to submit to chemical testing
- Caused an injury or great bodily harm
- Caused the death of another
