Two Green Bay men were charged with their 5th and 6th Operating While Intoxicated (OWI) offenses this week. In Wisconsin an OWI 5th or 6th is a Class H felony under Wisconsin Statute § 346.65(2m). Both are punishable by a minimum incarceration period of 6 months and a maximum penalty of 6 years imprisonment. Most felony OWI convictions result in prison time and include hefty fines. An OWI conviction will also lead to a driving license revocation and, in most cases, an order for an ignition interlock device. OWI offenses, whether your first or your sixth, can carry harsh penalties. All defendants are presumed innocent until proven guilty in court.
